Patient safety organizations (PSO) are a primary product of the Patient Safety and Quality Improvement Act of 2005. One key PSO benefit is the ability for health systems and hospitals to share protected details of care incidents to facilitate collective learning from adverse events. This article uses an Illinois legal decision as context to provide general guidance for policy, compliance, and litigation preparation for hospitals and clinicians that face litigation in response to medical error.
