This commentary explores legal and accountability issues associated with the use of the da Vinci surgical system, particularly whether the hospital or physician is responsible for training, credentialing, and privileging to utilize the device. The authors suggest that the hospital be responsible for providing opportunities to develop skills and confirm that physicians are prepared to safely use new technologies.
